Power of Attorney
A power of attorney for healthcare is a document in which you appoint an “agent” to make healthcare decisions for you in the event that you are unwilling or unable to make decisions for yourself. This document is flexible in that you define the kind of healthcare treatment you want or wish to avoid, and you may determine when the directive shall take effect. For example, you may choose to have a power of attorney for healthcare take effect immediately or upon your healthcare provider’s determination that you lack capacity to make your own healthcare decisions. Whether or not you have capacity to make your own healthcare decisions is a determination made by a physician. Until a power of attorney for healthcare becomes effective, you do not give up your control or your ability to make informed decisions for yourself.
